Jackson Capital USA LLC (“Jackson Capital,” “we,” “us”) arranges commercial equipment financing for businesses. We are a licensed finance broker, not a lender. This policy explains what information we collect, why we collect it, who we share it with, how we protect it, and how long we keep it.
What this policy covers. This policy describes information collected through jacksoncapitalusa.com and information you provide to us when you ask us to arrange financing. Statements in this policy about how we handle information refer to that information.
Our services are offered to businesses for business purposes. We do not arrange financing for personal, family, or household purposes. Information about individuals reaches us because the owners and guarantors of a business applicant are individuals, and lenders evaluate them personally when deciding whether to extend business credit.
Business information. Legal and trade name, address, entity type, Employer Identification Number, time in business, industry, revenue and financial statements, bank information, details of the equipment to be financed, and information about existing obligations.
Information about owners and guarantors. Name, home address, telephone number, email address, date of birth, Social Security number, ownership percentage, and personal financial information.
Documents you upload. Bank statements, tax returns, financial statements, equipment quotes, invoices, and identification.
Credit information. Consumer and business credit reports and scores obtained as described in Section 4.
Information you send us directly. The contents of emails, text messages, and calls, and any records we make of them.
We do not collect Social Security numbers, dates of birth, or financial account information from casual visitors to our website. We collect that information only when you apply for financing.
We collect information directly from you, through our online intake form, by email, by telephone, and through documents you send us. We also receive information from consumer reporting agencies and from prospective lenders in connection with your request.
Our intake form is hosted by a third-party form provider under a written agreement. Sensitive fields, including Social Security number, date of birth, home address, Employer Identification Number, and uploaded documents, are encrypted and subject to additional field-level protection.
With your written authorization, we obtain consumer and business credit reports to evaluate your request and identify lenders likely to approve it. Our initial inquiry is a soft inquiry, which does not affect your credit score.
Prospective lenders may obtain their own credit reports, and those inquiries may appear on your credit and may affect your score. That is the lender’s decision and is governed by the authorization you give the lender.
We use your information to evaluate your financing request, to identify and approach prospective lenders, to prepare and submit your application, to communicate with you about your request, to comply with legal and regulatory obligations, and to maintain our records.
We disclose the information covered by this policy only as follows:
Prospective lenders and funding sources, for the purpose of arranging the financing you have requested.
Service providers who support our operations, including our intake form provider, our cloud storage and email provider, our website analytics provider, and our credit report provider. Each is bound by a written agreement, and each is required by contract to maintain reasonable security procedures and practices appropriate to the information.
As required by law, including in response to a subpoena, court order, regulatory examination or request, or as necessary to establish or defend legal claims.
We do not sell the information covered by this policy. We do not rent or trade it, and we do not disclose it to third parties for those third parties’ own marketing purposes.
We maintain a written information security program appropriate to our size, the nature of our activities, and the sensitivity of the information we hold. It includes:
encryption of sensitive fields in our intake system and encryption of information in transit;
a rule that sensitive information is never transmitted by ordinary email, with notifications instead directing to a secure portal;
access limited to those who need the information to do their work;
multi-factor authentication on the systems that hold applicant information;
written agreements with our service providers addressing their security obligations; and
a documented process for responding to a suspected security incident.
No system is perfectly secure, and we do not promise that our safeguards will never be defeated. We do commit to maintaining reasonable safeguards and to notifying you as required by law if a breach affecting your personal information occurs.
Essential cookies. We use cookies and similar technologies necessary to operate this website and our intake form, including to maintain your session and to keep the form secure. These cannot be turned off without breaking the site.
Analytics. We use a third-party analytics service to understand how visitors find and use our website, so that we can improve it. This service collects information such as the pages you view, how long you spend on them, the website or search that referred you, your approximate geographic region, and general information about your browser and device.
Our analytics provider acts as our service provider under a written agreement. It is not permitted to use the information for its own purposes, to sell or share it, or to combine it with information it obtains from other sources or from its own interactions with you. We have disabled the advertising, audience, and personalization features of the analytics service.
What we do not do on this website. We do not use advertising networks, advertising or conversion pixels, remarketing or retargeting tags, session recording, or session replay. We do not build advertising audiences from visitors to this website, and we do not provide information collected through this website to advertising platforms.
Your choices. You can set your browser to refuse cookies or to alert you when one is set. Essential cookies aside, refusing them will not prevent you from using this website or submitting an application. We honor the Global Privacy Control signal where your browser sends one.
If this changes. If we add advertising tags, remarketing, or any tool that shares information collected through this website with a third party for advertising, we will update this policy before doing so and describe what is collected and how you can opt out.
We keep information for as long as needed to work your financing request, and afterward for as long as required by the recordkeeping obligations that apply to a licensed finance broker and by other applicable law. Working files are moved to our secure business storage and deleted from the intake system once your file is assembled.
When records are no longer to be retained, we dispose of them by shredding, erasing, or otherwise rendering the personal information unreadable.
You may decline to provide information. We cannot arrange financing without it, but the choice is yours.
You may ask what we hold about you, ask us to correct information that is inaccurate, or ask us to delete information we are not required to retain. Write to us at the address in Section 14 and we will respond within a reasonable time.
You may withdraw your credit authorization at any time as to future inquiries. That does not undo inquiries already made.
You may tell us to stop contacting you by telephone or text at any time, and we will honor that request. See Section 11.
If you give us your telephone number, we may contact you about your inquiry by call or text. Message and data rates may apply. You may opt out at any time by replying STOP to a text message, by telling us during a call, or by contacting us at the address in Section 14. We maintain an internal do-not-call list and honor requests to be placed on it.
Jackson Capital is a California business.
We do not sell information collected through this website or provided to us in connection with a financing request, and we do not share that information with third parties for cross-context behavioral advertising, as California law defines those terms. We do not disclose that information to third parties for those third parties’ own direct marketing purposes.
If our operations grow such that additional California privacy statutes apply to us, we will update this policy and provide the notices and rights those statutes require.
Children. Our services are for businesses. Our website is not directed to children and we do not knowingly collect information from anyone under eighteen.
Links to other sites. Our website may link to lender or vendor websites we do not control. This policy does not apply to them.
Changes to this policy. We may update this policy. The effective date above shows when it was last revised. If we make a material change, we will post the updated policy before the change takes effect. Material changes to how we handle information already collected will not be applied retroactively without notice to you.
