These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules.
Any dispute arising out of or relating to these Terms, this website, or our services will be resolved by binding arbitration administered by JAMS under its Comprehensive Arbitration Rules, before one arbitrator, seated in Los Angeles County, California. Judgment on the award may be entered in any court of competent jurisdiction.
You and Jackson Capital each waive any right to bring or participate in a class, collective, or representative action. The arbitrator may not consolidate claims or preside over any class or representative proceeding.
Either party may bring an individual claim in small claims court if it qualifies. Either party may seek injunctive relief in court to protect intellectual property or confidential information.
If the class waiver in this Section is found unenforceable, this Section 17 is void in its entirety and disputes will be resolved in the courts identified in Section 18.
If Section 17 does not apply, the state and federal courts located in Los Angeles County, California have exclusive jurisdiction, and you consent to their jurisdiction and venue.
We may revise these Terms. The effective date above shows when they were last revised. Revised Terms apply to your use of the website after they are posted. Applications already submitted are governed by the Terms in effect when submitted. If you do not agree to revised Terms, stop using the website.
If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor. These Terms, together with our Privacy Policy and any credit authorization or engagement agreement you sign, are the entire agreement between us regarding this website.
